Terms & Conditions
for the "Imaginaerium Festival" in Leipzig and its associated workshops
(Non-binding translation — the German version is legally authoritative. See imaginaerium.com/agb.)
1. Scope
1.1 These Terms and Conditions apply to attendance at the Imaginaerium Festival in Leipzig as well as to all workshops offered as part of the festival (jointly referred to below as the "Event").
1.2 The contracting party and organiser is:
Delkasch e.V.
Heinrich-Heine-Straße 53
04451 Borsdorf, Germany
Website: https://imaginaerium.com
1.3 Deviating terms and conditions of participants do not apply unless the organiser expressly agrees to them in text form.
2. Conclusion of contract and tickets
2.1 The display of event tickets and workshop places in the online shop or on other sales platforms does not constitute a legally binding offer, but a non-binding invitation for the customer to submit an offer.
2.2 By completing the booking process (e.g. clicking the "Book with payment obligation" button), the customer submits a binding offer to conclude a contract.
2.3 The contract is concluded upon confirmation by email or upon provision of the ticket/booking confirmation.
2.4 The ticket is personal and/or transferable only in accordance with the organiser's instructions on the booking page or on the ticket.
3. Prices and payment
3.1 The prices stated on the website or sales platform at the time of booking apply.
3.2 Payment is made exclusively by bank transfer.
3.3 The full ticket price is due immediately upon confirmation of the booking, unless expressly agreed otherwise.
4. Photo, film and audio recordings
4.1 Prohibition of private recordings
4.1.1 Private photo, film and audio recordings of the show and performances are not permitted anywhere on the Imaginaerium Festival event premises, including all workshop rooms, unless expressly and clearly indicated otherwise by the organiser.
4.1.2 The organiser is entitled to remove recording equipment intended for recording the show (e.g. professional cameras, video cameras) from the premises, or to prohibit its use. Violations may result in removal from the event without reimbursement of the ticket price.
4.2 Official photographer and consent
4.2.1 An official photographer and/or an official photo and, where applicable, video team is present at the festival and in the workshops, taking photo and, where applicable, film recordings of the event, the audience and the participants.
4.2.2 These recordings may be used for reporting on the event, for documentation, for future festival promotion, and for use in the organiser's online and offline media (e.g. website, social media channels, print materials).
4.2.3 By booking a ticket or a workshop place, the customer declares their consent that the organiser will make such recordings and process and publish them for the purposes stated, unless in an individual case there is an overriding legitimate interest of the person depicted to the contrary.
4.2.4 This consent covers in particular the processing of personal data in the form of image and, where applicable, audio recordings pursuant to Art. 6(1)(a) and (f) GDPR and §§ 22, 23 KunstUrhG (German Act on Copyright in Works of Fine Art and Photography).
4.2.5 As far as reasonably practicable, the organiser will clearly indicate during the event that photo and, where applicable, film recordings are taking place (e.g. signage at the entrance, notices during the booking process).
4.2.6 Participants who do not wish to be recorded are asked to inform the photographer or event team directly on site; the organiser will take this into account as far as reasonably practicable.
4.3 Withdrawal of consent
4.3.1 Consent once given may be withdrawn for the future. In this case, the organiser will, where possible and reasonable, no longer use or will remove the affected recordings.
4.3.2 A withdrawal does not affect the lawfulness of processing carried out prior to the withdrawal.
5. Workshops (booking, participation, cancellation)
5.1 Each workshop has a limited number of places; places are allocated in the order in which payments are received.
5.2 The content, duration, location and requirements of the workshops are set out in the respective workshop description at imaginaerium.com/workshops.
5.3 Participants are required to meet the participation requirements stated in the workshop description (e.g. minimum age, prior experience, physical fitness).
5.4 Cancellations by participants: Bindingly booked workshops or show tickets cannot be cancelled.
6. Admission, house rules and safety
6.1 Access to the festival and workshop premises is only permitted with a valid ticket.
6.2 Instructions from event staff must be followed; house rules are set by the organiser.
6.3 The organiser may refuse admission to, or exclude from the event, persons who violate these Terms and Conditions or staff instructions, or who endanger or disturb others; in these cases there is no entitlement to reimbursement of the ticket price.
6.4 The safety and hygiene rules published on the website or communicated in advance apply (e.g. prohibited items, smoking bans, requirements under youth protection law).
7. Data protection
7.1 The handling of participants' personal data (including data processed as part of the booking and the recordings described in section 4) is governed by the organiser's separate privacy policy.
7.2 The privacy policy is available at: imaginaerium.com/datenschutz.
8. Changes to the event
8.1 Programme items, artists, times and schedules of the festival may be changed for organisational reasons, provided this is reasonable for participants and does not materially impair the overall character of the event.
8.2 Minor changes do not entitle participants to a reduction of the ticket price or to withdraw from the contract.
9. Final provisions
9.1 The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.
9.2 If the customer is a merchant, a legal entity under public law, or a special fund under public law, the place of jurisdiction for all disputes arising from this contract is the organiser's registered office.
9.3 Should individual provisions of these Terms and Conditions be or become invalid, in whole or in part, the validity of the remaining provisions shall remain unaffected.
